Terms of Service

1. General Provisions

The MevaSearch Theme Marketplace ("Marketplace", "the Service") is a community platform operated by the MevaSearch Team, part of the WebOrbiton Team, for browsing, sharing, and submitting visual themes for MevaSearch (mevasearch.com).

The Marketplace is free to browse and use. It is a separate service from the MevaSearch premium search subscription and is governed by these Terms rather than the main MevaSearch Terms of Service.

By accessing or using the Marketplace, you agree to these Terms. If you do not agree, please do not use the Service.

2. Accounts

Browsing and applying themes does not require an account. Creating an account is required only to submit themes, favorite themes, or manage submissions you have made.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.

You must provide accurate information when registering. Accounts created with false or misleading information may be suspended.

3. Browsing and Using Themes

Themes listed on the Marketplace are style presets (colors, layout options, and related visual settings) intended for use within MevaSearch. Applying a theme changes only how MevaSearch is displayed to you; it does not modify MevaSearch's underlying functionality, data handling, or search behavior.

Themes are provided "as is" by their authors. We do not guarantee that any theme is free of visual defects, accessibility issues, or compatibility problems with future MevaSearch updates.

4. Submitting Themes

By submitting a theme, you confirm that:

• The theme is your own original work, or you hold the necessary rights to submit and license it under these Terms.
• The theme does not contain malicious code, tracking scripts, or any content designed to alter MevaSearch's functionality beyond visual styling.
• The theme does not infringe on the intellectual property, trademark, or other rights of any third party.
• The submitted metadata (name, description, author name) is accurate and not misleading.

You retain ownership of themes you submit. Submitting a theme grants MevaSearch a non-exclusive, worldwide, royalty-free license to host, display, and distribute the theme through the Marketplace, subject to the License terms described in our License page.

5. Review and Publishing

All submitted themes are reviewed before publishing. We may reject or request changes to a submission for any reason, including but not limited to visual quality, accessibility, suspected policy violations, or technical incompatibility.

Review times are not guaranteed. Approval of a theme does not constitute an endorsement of its author or design choices beyond meeting the Marketplace's technical and content standards.

6. Prohibited Conduct

When using the Marketplace, you agree not to:

• Submit themes containing malicious, deceptive, or harmful code.
• Impersonate another person, brand, or the MevaSearch Team when naming or describing a theme.
• Use automated tools to scrape, bulk-download, or mass-submit content to the Marketplace.
• Attempt to circumvent the review process or manipulate download/popularity counts.
• Upload themes that include offensive, discriminatory, or unlawful content.

Violations may result in submission rejection, removal of published themes, or account suspension.

7. Intellectual Property

"MevaSearch" and associated logos are the property of the WebOrbiton Team. Theme authors retain rights to their original design work, subject to the license granted under Section 4 and detailed in our License page.

You may not use the MevaSearch name or branding to suggest official endorsement of a third-party theme unless it is published by the MevaSearch Team.

8. Removal and Termination

We may remove a published theme at any time, including after publishing, if it is found to violate these Terms, infringe on third-party rights, or pose a technical or security risk.

We may suspend or terminate accounts that repeatedly violate these Terms or engage in abusive behavior toward the Service or other users.

9. Liability

The Marketplace and all listed themes are provided "as is," without warranties of any kind. We do not guarantee uninterrupted availability of the Service.

We are not liable for any visual, functional, or other issues arising from the use of a community-submitted theme. Theme authors are solely responsible for the content and quality of their submissions.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or legal requirements. Continued use of the Marketplace after changes are published constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by Polish law. Any disputes not resolved informally will be subject to the jurisdiction of the competent Polish courts, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
